Terms of Use and Sale

Terms of Use and Terms of Sale — Cadevia

This page is an English translation provided for convenience. The French version is the legally binding one; in case of discrepancy, the French text prevails.

Version 1.0 — effective October 1, 2026

1. Purpose and acceptance

These terms govern the use of the Cadevia app (the "App"), published by Emeric SAUNIER, sole proprietor (entrepreneur individuel), 10 rue du Gers, 31170 Tournefeuille, France, SIRET 934 473 562 00023 ("we", "Cadevia"), as well as subscribing to the subscription plans offered in it.

By creating an account or using the App, you accept these terms. If you do not accept them, do not use the App.

These terms are supplemented by our privacy policy, which forms an integral part of them.

2. What Cadevia is — and what it is not

Cadevia is a sports, wellness and training tracking app. It helps you set up your watch screens, record and analyze your workouts, understand your measurements (recovery, sleep, effort), track your nutrition and, if you subscribe to it, get a personalized training plan and talk with an automated coach.

⚠️ Cadevia is not a medical device

Cadevia diagnoses nothing, screens for nothing, treats nothing, monitors no disease and replaces no healthcare professional.

The indicators displayed — recovery, stress, energy, biological age, load, zones — are estimates of wellness and athletic performance, computed from consumer-grade measurements. They are neither an examination, nor medical advice, nor a reason to start, change or stop a treatment.

Before resuming or intensifying physical activity, especially if you have a cardiovascular, respiratory or metabolic history, if you are pregnant, or if you feel unusual pain: see a doctor. In case of faintness, chest pain, abnormal shortness of breath or any worrying symptom during exercise, stop and call emergency services (15 or 112).

The App's nutritional advice constitutes neither a dietary prescription nor a treatment for an eating disorder. If you follow a medical diet, talk to your doctor or dietitian before following the proposed targets.

You remain responsible for your athletic and dietary choices. The App is a tool; you decide.

3. Your account

3.1 Minimum age. The App is reserved for adults (18 years of age or older). By creating an account, you declare that you are 18 or older.

3.2 Creation. An account is required to use the App. You can create it with an email and password, or through "Sign in with Apple".

3.3 Accuracy. The information you provide (weight, age, sex, level, medical history) is used to compute your targets and your plan. Inaccurate information produces unsuitable recommendations: keep it up to date.

3.4 Security. You are responsible for the confidentiality of your credentials and for the activities carried out from your account. Notify us without delay at contact@cadevia.app if you suspect unauthorized access.

3.5 One account, one person. The account is personal. It is not to be shared or transferred.

3.6 Deletion. You can delete your account at any time from your Profile. Deletion is permanent: we erase your account from our servers. It does not end your subscription: that is canceled with Apple (§5.5).

4. Use of the App

4.1 License. We grant you a personal, non-exclusive, non-transferable and revocable right to use the App, for your own needs, on the devices you own or control, for the duration of your subscription.

4.2 What you agree not to do:

4.3 Quotas. The use of artificial intelligence features is capped per day and per account, to preserve the quality of the service and control its cost. These caps are set at a level well above normal use. If you reach it, the App tells you and the counter resets the next day.

5. Subscriptions, prices and payment

5.1 The plans. Cadevia is used with a subscription. Without one, you keep limited access: the Home screen (your daily measurements) and your Profile. Everything else requires one of two plans:

PlanMonthlyYearlyContent
Cadevia€9.99€89.99Everything, except the Coach
Cadevia + Coach€14.99€134.99Everything, Coach and conversation with the Cadevia Coach included

The prices shown are inclusive of all taxes, in euros, for France. They may vary by territory and exchange rate, in accordance with Apple's price tiers. The price displayed in the App at the time of purchase prevails.

5.2 Free trial. A 7-day trial giving access to all features is offered to new subscribers. At the end of the trial, the subscription you chose starts and is billed automatically, unless you canceled it at least 24 hours before the end of the trial. Apple grants only one trial offer per person and per subscription group.

5.3 Automatic renewal. Subscriptions renew automatically at the end of each period (monthly or yearly) and are charged to your Apple account within the 24 hours preceding the end of the current period, at the rate then in effect.

5.4 The seller is Apple. Subscriptions are sold by Apple, through the App Store, which acts as the seller (merchant of record). The sales contract and the payment therefore bind you to Apple, under the Apple Media Services Terms and Conditions. We have access neither to your payment method nor to your banking details.

5.5 Cancellation. You can cancel at any time from iOS Settings → your name → Subscriptions, at least 24 hours before the end of the current period. Cancellation takes effect at the end of the period already paid: you keep access until then. No pro-rated refund is due for a period already started; refund requests are handled by Apple.

5.6 Right of withdrawal. As this is digital content supplied immediately, the 14-day right of withdrawal provided for by Article L.221-18 of the French Consumer Code is exercised, where applicable, with Apple, which is the seller. Apple applies its own refund policy, generally more favorable: you can request a refund at reportaproblem.apple.com.

5.7 Price changes. We may change the prices. Any increase will be notified to you by Apple before it takes effect and will only apply after your consent or, failing that, will result in your subscription not being renewed. The price of a period already paid never changes.

5.8 Changing plans. Switching from "Cadevia" to "Cadevia + Coach" (or the reverse) is done from the App or from your Apple subscription settings. Apple calculates the pro-rated amount.

6. The Coach and artificial intelligence

6.1 You are talking to a machine. The "Cadevia Coach" is an automated service based on an artificial intelligence model. It is not a human being, nor a certified trainer, nor a healthcare professional. The App tells you so clearly.

6.2 What we guarantee — and what we do not guarantee. The figures displayed in the App are computed by our own engines, from your real measurements. The role of the artificial intelligence is to explain them and to compose workouts, not to invent them. We do not, however, guarantee that every response produced is accurate, complete or suited to your situation: re-read, and use common sense. In the event of a contradiction between a figure displayed by the App and a sentence from the Coach, the displayed figure prevails.

6.3 No medical advice. The Coach makes no diagnosis and prescribes no treatment. See the box in §2.

6.4 Your content. You remain the owner of the photos, texts and data you enter. You grant us only the strictly limited and free-of-charge right to process them to provide you the service you request (analyze a meal photo, answer your question). We do not use them for any other purpose, and we do not use them to train an artificial intelligence model. See the privacy policy.

6.5 Availability. Artificial intelligence features require a connection and a signed-in account. In the event of unavailability, the App says so honestly and falls back on its local engines when it can.

7. Third-party services and hardware

The App can connect to services and hardware that we do not control: Apple Health, Strava, Bluetooth sensors, base map providers. Their operation, their availability and the processing of your data by these third parties are governed by their own terms.

We do not guarantee the continued availability of these integrations: a third party may change or close its interface. If so, we will inform you and adapt the App.

These third parties owe you no warranty in respect of the App: on their behalf, all warranties are disclaimed, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, and they shall have no liability for any consequential, special, punitive or indirect damages related to the App. This clause concerns these third parties only: it does not reduce the rights the law guarantees you against us (§10).

8. Intellectual property

8.1 Our rights. The App, its code, its design, its texts, its illustrations, its calculation engines, its training knowledge base and its "Cadevia" trademark are protected and belong to us (or are licensed to us). Nothing in these terms transfers any right over them to you.

8.2 Content under open licenses. The App incorporates data published under open licenses — in particular map data © OpenStreetMap contributors (ODbL license), the Ciqual (ANSES) nutritional composition table, a public-domain exercise database and weather data from Open-Meteo (CC BY 4.0). The corresponding attributions appear in the App. Details are available on request at contact@cadevia.app.

8.3 Third-party trademarks. Apple, Apple Watch, HealthKit, Strava and the other trademarks mentioned belong to their respective owners. Their mention implies no partnership.

9. Availability and evolution of the service

We strive to ensure the availability of the App, without being able to guarantee it without interruption: maintenance, failure of a third party, or force majeure.

We may change the App, add, modify or remove features. If a substantial feature of your plan were permanently removed, you could cancel your subscription at no cost for the remaining period, under the conditions of §5.5.

Offline operation. A large part of the App works without a network (recording a workout, watch screens, downloaded map areas, journal). Features that require a network tell you so.

10. Liability

10.1 We are bound by a best-efforts obligation (obligation de moyens). Our liability can only be incurred in the event of proven fault and for direct and foreseeable damage.

10.2 We are not liable for: the consequences of use that does not comply with these terms or with the box in §2; an injury or health problem occurring during physical activity; the inaccuracy of data provided by a device, a sensor or a third-party service; the loss of data on your device that you have not backed up; the unavailability of a third-party service.

10.3 Except in the case of gross negligence or bodily injury, and to the extent permitted by law, our total liability is capped at the amount of the sums you paid for your subscription during the twelve months preceding the triggering event.

10.4 Nothing in these terms limits the rights that French law grants to consumers, in particular the legal guarantee of conformity for digital content and services (Articles L.224-25-12 et seq. of the French Consumer Code) and the warranty against hidden defects.

11. Suspension and termination by us

We may suspend or close an account, after having notified you and given you a reasonable time to explain yourself except in an emergency, in the event of a serious breach of §4.2, fraudulent use, or non-payment. In the event of closure for a reason not attributable to you, we will refund you the paid period not used.

12. Provisions specific to distribution through the App Store

These provisions are required by Apple for any app distributed on the App Store and prevail in the event of contradiction with the rest of these terms:

1. This agreement is concluded between you and us only, and not with Apple. We are solely responsible for the App and its content. 2. The license granted to you is limited to use of the App on any Apple device that you own or control, under the Apple Media Services terms of use. 3. Apple has no maintenance or support obligation relating to the App. 4. In the event of the App's failure to conform to any applicable warranty, you may notify Apple, which may refund you the purchase price, if any. To the extent permitted by law, Apple will have no other warranty obligation, and any other claim is our responsibility. 5. We are responsible for addressing any claim relating to the App: its product liability, its compliance with regulations, and claims under consumer law. 6. In the event of a third-party claim alleging that the App infringes its intellectual property rights, we are the ones who handle the investigation, defense and settlement. 7. You declare that you are not located in a country subject to a U.S. embargo or designated by the U.S. as supporting terrorism, and that you are not listed on any U.S. list of prohibited or restricted parties. 8. Apple and its subsidiaries are third-party beneficiaries of this agreement and have the right to enforce it directly against you.

13. Personal data

The processing of your personal data is described in our privacy policy. In short: your health and training data stays on your device; our servers hold only your identity and your subscription; some data is transmitted to our artificial intelligence provider, with your prior explicit consent, solely to produce the answer you request.

14. Changes to these terms

We may change these terms. Any substantial change will be notified to you in the App at least 30 days before it takes effect. If it does not suit you, you can cancel your subscription before that date. Continued use after the effective date constitutes acceptance.

15. Miscellaneous

If any provision were held to be void, the others would remain applicable. Failure to rely on a breach does not constitute a waiver. We may assign this agreement as part of a transaction involving the business, without your rights being diminished; you would be informed.

16. Governing law and disputes

16.1 Complaint. In the event of a problem, write to us first at contact@cadevia.app: we reply within 14 days.

16.2 Consumer mediation. In accordance with Article L.612-1 of the French Consumer Code, if our answer to your complaint does not satisfy you, you may refer the matter free of charge to a consumer mediator (médiateur de la consommation). Its contact details will be given here as soon as Cadevia opens to the public on the App Store. Referral to the mediator requires a prior written complaint to us.

16.3 Governing law. These terms are governed by French law. If you reside in another Member State of the European Union, you retain the benefit of the more protective mandatory provisions of your country of residence.

16.4 Jurisdiction. Failing an amicable agreement, the dispute will be brought before the competent courts. As a consumer, you may bring proceedings either before the court of the place where you resided at the time the contract was concluded, or that of the place where the harmful event occurred, or that of the defendant's domicile (Article R.631-3 of the French Consumer Code).
